Checks for a new-build purchase
Separate a completed new apartment from an off-plan promise. The less physical product exists, the more work the contract and independent technical review must do.

Checks for a resale purchase
A finished property reduces uncertainty about the physical product, not the legal file. Match the cadastral description to what is physically present and budget for the whole building, not only the apartment.

- Registered area, use, floor and unit compared with the property

Do not compare prices before confirming tax treatment
New build and resale are not automatically taxed in the same way. Whether VAT or real-estate transfer tax applies depends on the seller, the nature of the supply and the exact transaction. The 2026 tax amendments also changed the treatment of VAT-taxed construction land.
Ask the responsible lawyer, tax adviser or authority for a written transaction-specific calculation before signing. Compare total acquisition cost: advertised price, applicable tax, notary, interpreter, legal and technical review, registration, furnishing, renovation and recurring charges.

Is a new-build apartment safer than a resale property?
Not automatically. The risk profile is different. A completed new build reduces age-related maintenance but still requires checks of the developer, permits, specification, defects, management and registration. A resale home requires title, alteration and technical-condition checks.
Do new builds in Montenegro have transfer tax?
Tax treatment depends on the exact seller and transaction. A qualifying VAT-taxed supply and a resale subject to transfer tax are treated differently. Obtain a written calculation for the specific contract rather than relying on the listing label.
What is the biggest off-plan risk?
The gap between what is promised and what is delivered: timing, area, specification, common facilities and registration. The contract should define evidence-based milestones, remedies, handover and refund or termination conditions.
What should I inspect in an older apartment?
Inspect the unit and the whole building: structure, roof, façade, damp, windows, plumbing, electricity, lifts, common areas and planned works. Compare physical alterations with the cadastral and permit file.
